Filmtime Performance Guarantee

Oh, hi there. We assume you’re here because you want to know more about our guarantees.

Welcome! Depending on your situation, you may qualify for either our Performance Guarantee or our Conversion Guarantee. The details for both can be found below. We’ll improve your results by at least 30% over what your existing website and paid traffic are currently getting, or you won’t pay us a cent!

 

Here’s the deal:

  1. The Filmtime Performance Guarantee applies to all Filmtime web project types, except Major Sales Funnels and Full Websites. There’s no negotiation there. So don’t ask.
  2. You sign up with us and pay us according to the contract throughout the minimum term. We’re not doing that thing where you super-promise to pay us when we hit the guarantees.
  3. You need to have an existing business at the time you sign up with us (actually live and trading, not just a dormant domain or a registered business name). We can’t improve the performance of something that doesn’t exist, right?
  4. You must have profitably (you made more than you spent) run a conversion campaign – which means a campaign for purchases or leads, NOT just forms – for paid traffic (Facebook or Google Ads, if applicable) prior to signing up with us, and you need to be able to prove it through Google Analytics, Google Ads, or Facebook Ads Manager. We will do an audit on the data to make sure there’s no double-tracking or other issues that may cause inaccurate data. If we ask you for additional evidence, please provide it. Don’t give us blurry screenshots and stuff written on post-it notes. We’ve been hurt before.
  5. The campaigns you want us to run for you must be comparable to what you had before – that means the same product or service, same seasonality (if applicable) and same ad spend. If your previous campaign exploded (in a good way) due to acts of God or events that were not reasonably within your (or our) control (think COVID, hurricanes, lions, tigers, bears, and other extraordinary man-made or political events), then your previous campaign isn’t comparable. We can’t compare the results of a $4k per month macrame basket campaign being targeted to the Gold Coast in summer with a $1k women’s bikini wear line being sold nationally in the dead of winter. While White Walkers like to look cute, they’re just not that into swimwear. Facebook to Facebook. Google Ads to Google Ads. Summer to summer. $10k to $10k. Pandemic to pandemic (ouch, #toosoon). Apples to apples.
    1. Hello, it’s us again. We want to make sure you’re really clear about what we’re saying here. If you ran a novelty sock campaign over winter in Australia with a $10k ad budget previously, and you want us to run a novelty sock campaign over winter in Australia with a $10k ad budget…that’s comparable. If you want us to run a novelty t-shirt campaign over winter in Australia with a $2k ad budget instead…well, that’s not comparable.
    2. Comparable. It means likened to another, equivalent, worthy of comparison.
    3. We decide what’s comparable. You know why? Because we’re digital marketing experts. If you disagree with us, then we’d rather just part ways and not get into a skirmish about it.
  6. You must not be selling anything even remotely shady, illegal, scammy, dangerous or in any way be involved in multi-level marketing (also known as network marketing or pyramid selling). We also just recommend this as life advice – make better choices. Not sure if this applies to you?   7. This guarantee only applies to a combination of both an eligible new Filmtime-built web project and Filmtime-run paid traffic. No exceptions.
  8. You need to let us have full creative control – that means if you want to change your website or ads against our recommendation, then the guarantees don’t apply. You must be willing to let us create ads we think will sell. Listen, since we’re doing this all on our own dime…frankly, we don’t care what you, your business partner, your spouse, your friends or Snow White and the seven dwarfs think about our work.
  9. We can’t stress this enough, and we want to make sure you were paying attention to number 8: except for checking the ads for your legal and factual approval – we hold all creative control. If an ad isn’t ours, we can’t guarantee its success.
  10. We have the minimum term of your paid traffic contract to achieve a combined improvement of 30% or more in your Filmtime-built web project conversion rate AND your Cost Per Lead (CPL) or Cost Per Acquisition (CPA) over a 30-day period.
  11. These scenarios are based on us running a comparable campaign to what you previously had (same seasonality, same ad spend, same time period, no random hurricanes or tiger attacks). Let us explain:
    1. Scenario One.

Conversion. Before you came to us, your website converted at 1.91%. You were able to prove that to us using Google Analytics. The website we made for you converts at an average rate of 3.58% over a 30-day period during your minimum term. That’s an uplift of 87.4%.

Paid Traffic. Before you came to us, you were getting a CPL of $65.50 on Facebook. You were able to prove that to us using Facebook Ads Manager. The campaign we ran for you achieved an average CPL of $42.00 over a 30-day period during your minimum term. That’s a decrease of 35.9%.

Outcome. By combining the conversion improvement of 87.4% and the CPL improvement of 35.9%, we’ve improved your results by 123.3% and we’ve exceeded the 30% improvement guarantee by 93.3%. You are not entitled to a refund of any fees paid to Filmtime.

    1. Scenario Two

Conversion. Before you came to us, your website converted at 1.91%. You were able to prove that to us using Google Analytics. The website we made for you converts at an average rate of 1.92% over a 30-day period. That’s an uplift of 0.52%.

Paid Traffic. Before you came to us, you were getting a CPA of $65.50 on Facebook. You were able to prove that to us using your Facebook Ads Manager account. The campaign we ran for you achieved an average CPA of $42.00 over a 30-day period during your minimum term. That’s a decrease of 35.9%.

Outcome. By combining the conversion improvement of 0.52% and the CPA decrease of 35.9%, we’ve improved your results by 36.42% and we’ve exceeded the 30% improvement guarantee by 6.42%. You are not entitled to a refund of any fees paid to Filmtime.

    1. Scenario Three

Conversion. Before you came to us, your website converted at 1.91%. You were able to prove that to us using Google Analytics. The website we made for you converts at an average rate of 1.92% over a 30-day period. That’s an uplift of 0.52%.

Paid Traffic. Before you came to us, you were getting a CPA of $65.50 on Google Ads. You were able to prove that to us using your Google Ads account or Google Analytics. The campaign we ran for you achieved an average CPA of $59.00 over a 30-day period during your minimum term. That’s a decrease of 9.9%.

Outcome. By combining the conversion improvement of 0.52% and the CPA decrease of 9.9%, we’ve improved your results by 10.42% but we’ve fallen short of the 30% improvement guarantee by 19.58%. You are entitled to a full refund of your web project and monthly management fees for the minimum term.

  1. In summary, if we don’t achieve a 30% improvement over a 30-day period during the minimum term of your paid traffic contract on the combined service of a web project and paid traffic campaign that we built for you, we will refund what you paid us for your web project and your monthly management fees for the entire minimum term. We know. Bonkers, right?

 

The Stuff That We Need To Be Really Clear About And You Need To Understand

We are so proud of our work, and we are excited as hell to offer this guarantee to our customers. Excited as hell doesn’t mean crazy as hell though. We all need to play fair because this is an f’ing fantastic guarantee, so please make sure you understand the following:

  1. This guarantee is for new customers who sign on for eligible services with us after 11 May 2021. If you are a current customer and you’re signing on to eligible services for the first time after 11 May 2021, you qualify too – providing you have an existing website that we can compare our results to. If we are building your first website for you, that doesn’t count…because we can’t compare a website to thin air. That’s just science.
  2. This guarantee is a BONUS to your services with us. If this guarantee is the only reason you’re signing on with us, then don’t do it – because there are lots of variables that can impact whether the guarantee applies. Our guarantee is just one part of our entire contract. Don’t be getting all selective about what you read. You can’t use this as an excuse to bail on an agreement that you signed. We will confirm your eligibility for the Conversion Guarantee during the onboarding process.
  3. You need to let us have full creative control – that means if you want to change your website against our recommendation, then the guarantees don’t apply. You must be willing to let us create a website we think will convert. Listen, since we’re doing this all at our own risk…frankly, we don’t care what you, your business partner, your spouse, your friends or Snow White and the seven dwarfs think about our work.
  4. You need to pay your monthly management fees and web project fees on time, without set off, deduction or counterclaim.
  5. This guarantee doesn’t apply to management fees for recurring services. That’s a totally different thing.
  6. If you have paid traffic with us, you need to pay for your ad spend. If your ads go down due to funding issues (which you have full control over) for more than 7 consecutive days, the guarantee is voided.
  7. If a related paid traffic campaign is on hold at no fault of King Kong for a consecutive period of 90 days or more during the minimum term, the guarantee is voided.
  8. If you cause your website to perform poorly for the end user (for instance, you move it to a super slow server in the mountains of Serbia, or load it up with a bunch of plugin gremlins that make your website perform as though it’s taken a bunch of questionable pills and repeatedly shouts “WOAH DUUUUUUDE” every time it sees a fork) – because this stuff is through no fault of Filmtime – and we can’t run ads to it for more than 7 consecutive days, the guarantee is voided.
  9. If you are aware of an issue or circumstance that would impact our ability to fulfil our obligations under this guarantee and you don’t disclose that to us at the time you sign up with us, the guarantees are void.
  10. If we can’t get your ads live due to issues with your business advertising on the applicable traffic platform, the guarantees are void. For instance, if your domain has been blocked by Facebook previously…well, we don’t know Zucks like that. We’ll try our best to get around it, but we may not be able to overcome the issue. If we can’t get traffic to your site, your site can’t convert. So we don’t even get a chance to meet the guarantee. Don’t put us in that position. We don’t like it.
  11. You can’t otherwise breach the terms and conditions.
  12. If you can’t prove your previous results through Google Analytics, the

Guarantees don’t apply.

  1. Our terms and conditions are final.
  2. TL;DR (that’s Too Long; Didn’t Read): don’t enter into this with anything but

good faith. We will do the right thing, and you need to do the right thing too. The aim here is to get fantastic results for your business so you can scale what you do to breathtaking heights, not for you to game the system to get free work out of us. If you think you might be doing this for the wrong reasons, give us a miss. The last thing we want to do is get in a p*ssing match with you – so we’re all going to be professional and play fair, okay? We can’t stress this enough…don’t make it weird.
